N-120, KM 313.4, - 24391 Valverde de la Virgen (León), hereinafter referred to as “the company,” contacts users of social networks (hereinafter, “the user”) to request their permission and authorization to use and display user-generated content (hereinafter, “user-generated content” or “UGC”) on social networks, blogs, websites, and other digital media (such as email, digital newsletters, apps, or other media that may emerge in the future).

If you are reading these terms and conditions of use (hereinafter, “the terms of use” or “these terms”), it is because the company has requested your permission to use the post in accordance with these terms.

By responding with the hashtags #siandbeyoubrand, #siandbeyou, #yesandbeyoubrand, or #yesandbeyou, the user authorizes the company to use the UGC and implicitly accepts the terms of use described herein, committing to comply with them in full.

The company reserves the right to modify these terms without prior notice; therefore, it is necessary to review the terms of use each time you grant permission to use user-generated content.

Hereby, the user grants the company and its associates and/or affiliates (hereinafter, “the authorized parties”) the unlimited, worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, and royalty-free right to use, publish, copy, edit, alter, reproduce, display, distribute, and commercially exploit the UGC in all known formats and distribution channels, as well as those that may be developed in the future. 

The user further confirms that:

• They are over 18 years old
• They are solely responsible for the user-generated content.
• They own all rights to the user-generated content or have obtained the rights from all persons who own, manage, or claim any rights regarding such UGC.
• This content does not violate third-party rights (copyright, privacy rights, intellectual property rights, or any other nature) nor infringes any law.
• They have full power and authority to accept and grant the rights described in these terms.

The user grants the authorized parties the right to use their username, real name, alias, image, portrait, avatar, profile picture, profile information, biographical information, appearance, voice, descriptions, captions, location, or any other identifying information in connection with the use of their UGC.

User-generated content will be considered non-confidential, and the authorized parties are not obliged to maintain the confidentiality of such content, except as required by the applicable Privacy Policy. Furthermore, user-generated content lacks property rights.

The authorized parties reserve the right to remove any user-generated content

The user releases the authorized parties from all liability related to the use of the user-generated content and/or any infringement of rights in relation to such content.

Your personal data will be processed in accordance with Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD) and other applicable data protection regulations. You can exercise your rights of access, rectification, portability, and deletion of your data and the limitation and opposition to its processing by contacting Crta.
